The driver of the motorcycle – a dirt bike – was charged with Operating an Off-Highway Vehicle on Property without written permission of Sydney Coal Railway; under the Off-Highway Vehicles Act, this Summary Offence carries a fine of $406.45.  Police also issued a Protection of Property Order prohibiting the man from entering Sydney Coal Railway property and rail bed, for a period of 1 year.

Police originally responded to the scene of the collision near May Street and Daley Road at approximately 3:00 PM on November 24th. The driver of the dirt bike, who was traveling on the railway tracks, was unable to get off the tracks in time for an approaching train; the driver jumped off the bike before the collision and escaped injuries. The bike received minor damage. There was no damage to the train and no injuries as a result of the collision.
